This Privacy Policy (“Policy”) describes the types of personal information Pharmavite LLC (“Pharmavite,” “us,” “we,” or “our”) collects about you when you access, use or navigate our website, www.naturemade.com (“Site”), or when you communicate with us, interact with us, or otherwise provide us with information, how we use that information, who we disclose it to, and certain rights you may have regarding your personal information.

This Policy does not apply to our subsidiaries and the brands of our subsidiaries or to our corporate website, www.pharmavite.com. As discussed below, you should be aware that we may make your personal information available to our subsidiaries, subject to this Policy.

If you do not agree with the collection, use, processing and disclosure of your personal information as described in this Policy, do not share your personal information with us. By reaching out to us by phone, email or postal mail, or by accessing or using our Site, you agree to our use of your information as described in this Policy.

PERSONAL INFORMATION WE COLLECT OR RECEIVE ABOUT YOU (NOTICE OF COLLECTION)

For purposes of this Policy, “Personal Information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you. It does not include publicly available information.

The types of Personal Information we may have collected and processed in the past 12 months and expect to collect and process in the future include the following categories of Personal Information:

D. Commercial information Shopping, purchasing or consuming histories or tendencies and other information relating to your interests and shopping behavior.
E. Biometric information Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as physical patterns, and sleep, health, or exercise data.
F. Internet Activity. Internet or other similar network browsing history, search history, information on your interaction with a website, application, or advertisement, including type of content and ads you view or interact with, how you interact with them, and the time, frequency and duration of your activities.
G. Location data. Physical location or movements, including device location or estimated location based on your IP address.
H. Audio, electronic, visual, thermal, olfactory, or similar information Photos or videos you provide, and voice recordings, such as calls to our customer care team.
I. Inferences Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
J. User Content and Communications To the extent it qualifies as Personal Information, comments, posts, ideas, reviews, feedback, photos, videos or other content you submit or otherwise provide, including communications or inquiries you have submitted to us, including through email, calls, chat functionalities on our Site or other applications, forms, social media, or other means. This includes information you provide in response to customer surveys, quizzes, sweepstakes, questionnaires, or intake forms.
K. Sensitive Personal Information a. Personal Information that reveals:
i. Your account-log in, debit or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
ii. Precise geolocation;
iii. Racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs;
iv. Contents of a consumer’s email and text messages, unless the business is the intended recipient thereof; or
v. Genetic data
b. Biometric data processed for the purpose of uniquely identifying a consumer; or
c. Personal Information collected concerning your health, sex life or sexual orientation. (Residents of Washington, Connecticut and Nevada should review our Consumer Health Data Privacy Policy).

 

We retain each of the categories of Personal Information listed above for the period we believe is reasonably necessary to provide goods and services to you and for the period reasonably necessary to support our business operational purposes listed under “How We Use Your Information.”

HOW WE USE YOUR INFORMATION

We may use the Personal Information we collect, including information that we combine from your interactions with our Site, from you and your device, from service providers or third parties, for a variety of purposes. Here are ways we use your Personal Information:

  • To provide information and communicate with you, such as responding to your questions and comments when you communicate with us and providing you with other information that may be of interest to you;
  • To provide, improve and develop our and our subsidiaries’ products and services and market, promote, advertise and sell them to you;
  • To remember, personalize, facilitate and/or enrich your experiences with us, including providing personalized product recommendations and targeted advertising;
  • To manage your account with us, including setting up, registering, and maintaining your account with us;
  • For business purposes, including to perform business analyses and research, and operate and improve our business and business activities, to help prevent and detect, and respond to security incidents, identity theft, fraud and any activity that is illegal, to address violations of law or other misuse of the Site or our products and services, and for any other business purpose permitted by law; and
  • For legal and safety purposes, including to comply with our legal and regulatory obligations, which arise from time to time, to protect our or others’ rights, privacy, safety or property, and/or that of our affiliates; to maintain the security of our customers, employees, and property, and to pursue remedies available to us and limit our damages.

We may combine or aggregate any information we collect for any of these purposes.  We may also de-identify and/or anonymize your Personal Information in such a way that you may not reasonably be re-identified by us or any other organization and may use such de-identified or anonymized information for any purpose. When we do so, we take reasonable measures to ensure that the information cannot be associated with a consumer or household, and we maintain and use the information in deidentified form. We will not attempt to reidentify the information, except that we may attempt to reidentify it solely for the purpose of determining whether our deidentification processes satisfy applicable legal requirements. After it has been deidentified, the information is no longer Personal Information and is not subject to this Policy.

For certain purposes, we give you choices and/or obtain your consent as required by applicable law – for example, where required by law, we may obtain your consent to use your sensitive personal information for advertising or marketing purposes.

Please also note that we may also process your Personal Information via use of automated technologies, including artificial intelligence, for the purposes listed above. To the extent permitted by applicable law, we may also use Personal Information we collect to train automated technologies we use for the above purposes.

HOW WE DISCLOSE YOUR INFORMATION TO OTHERS

Disclosures to Service Providers

In the past 12 months we have disclosed, and expect to continue to disclose, each of the categories of Personal Information described above to our service providers and contractors for business purposes, including to maintain or service accounts, provide customer service, process payments, fulfill orders, communicate with you, provide advertising or marketing services, provide analytic services, support internal research, verify service quality, address security and prevent fraud, support our business, and/or to provide similar services on our behalf.

Disclosures to Contractors/Third Parties

In the past 12 months we have disclosed, and we may disclose in the future, the information set forth in the categories noted above-entitled Identifiers, Personal Information, Classification Information, Commercial Information, Internet Activity, Location Data, and Inferences as follows:

  • To business partners, such as ad networks or social media entities, for analytical purposes or who may deliver marketing communications, promotional materials, or advertisements that may be of interest to you. These business partners may engage in cross-contextual behavioral advertising on our behalf;
  • To subsidiaries, who may deliver marketing communications, promotional material, or advertisements that may be of interest to you regarding their brands;
  • To contractors/ third parties when you engage in or interact with co-branded or co-sponsored content or activities; and
  • To contractors/ third parties to assist in fraud detection.

We are required to describe certain disclosures of Personal Information as “sales” where we receive valuable consideration. No money is paid in exchange for your Personal Information. However, because certain disclosures of Personal Information to third parties for marketing purposes may constitute “sales” and/or “shares” under applicable privacy laws, we provide notice here that we sell and share, and have sold and shared in the past 12 months Identifiers, information set forth in the categories noted above entitled Identifiers, Personal Information, Classification Information, Commercial Information, Internet Activity, Location Data and Inferences to the categories of third parties listed above for marketing, and analytic purposes. For more details or to opt out of the sale/sharing of your Personal Information, please see the “Right to Opt Out of Sales and Sharing; Right to Limit” section, below.

Other Disclosures

Additionally, we may have disclosed in the past 12 months, and we may disclose in the future each of the above-listed categories of Personal Information in the following contexts:

  • Upon your request or approval, though we may not be able to accommodate all requests.
  • As reasonably necessary to facilitate a merger, acquisition, sale, joint venture or collaboration, reorganization, divestiture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings), or other types of strategic business transactions.
  • To law enforcement, government entities, including regulatory agencies and courts, as reasonably necessary for our business operational purposes, to assert and defend legal claims, and otherwise as permitted or required by law.

SOURCES OF INFORMATION

We obtain Personal Information from the following categories of sources as further explained below:

  • Directly from you. When you interact directly with us, such as when you sign up for text messages or marketing emails, send us or respond to email(s), register for an account or subscription, purchase products through our Site, interact with our Consumer Affairs team, complete forms accessible from the Site or sent to you or our surveys, or interact with Nature Made® social media pages or other third-party platform.
  • Automatically When You Interact with our Site, Our Emails or Advertisements. Subject to your device settings, we automatically collect certain personal information when you interact with our Site on any device or click on sponsored links or third-party ads to visit our Site. We may also collect personal information about you over time and across different websites, apps and devices when you use our Site, using tracking technologies such as cookies, beacons, pixels, flash objects, APIs and mobile software development kits (SDKs) and we may use third party services to collect this personal information when you use our Site. We explain more about our use of cookies and other tracking technologies in the section called “Choices Concerning Cookies and Other Tracking Technologies” below.
  • Our Affiliates. We may receive personal information from our subsidiaries and other affiliates,
  • Service Providers and Third Parties. We have and will continue to collect personal information from service providers and third parties. For example, this may include receiving personal information from: (i) from our marketing partners, analytics vendors, and companies that co-sponsor our promotions, (ii) advertising networks and publishers (including profile information from online publishers, which includes items such as household status, income, educational information, etc.), with the information received dependent upon the online publisher; (iii) social media sites, including without limitation, Facebook, Twitter, YouTube, Pinterest, Snapchat, Tik Tok and Instagram (which information is dependent upon the social media site’s policies and your settings on that site); (iv) third party sites, including those that allow you to integrate your third-party account with your Nature Made account; (v) family, friends and others who provide your personal information to us because they think you may be interested in our products and services or they want to share a product or service with you; (vi) companies that provide personal information to supplement what we already know about you, including data analytics firms data aggregator, and data brokers; or (vii) publicly available sources, including social media sites and public databases
  • By Combining Personal Information. For example, we may combine personal information that we collect offline with personal information we collect through our Site, combine personal information we collect about you from the different devices you use to access our Site, or combine personal information we get from third parties with personal information we already have about you.

HOW WE PROTECT INFORMATION WE COLLECT

We build security into our system to help protect data from unauthorized access, disclosure, alteration, and destruction. We employ reasonable and appropriate physical, technical, and organizational safeguards designed to promote the security of our systems and protect the confidentiality, integrity, availability, and resilience of your Personal Information.

We’re always looking for threats and take reasonable steps to respond to those threats, protecting the information users share with us.  Of course, no method of Internet transmission or data storage can provide guaranteed protection to your Personal Information.  If anything should ever happen to your Personal Information, we’ll let you know as soon as we can and try our best to make it right.

CHILDREN UNDER THE AGE OF 16

Our Site is not intended for children under 16 years of age. No one under age 16 may provide any Personal Information on the Site. We do not knowingly collect Personal Information from children under 16, nor do we knowingly disclose Personal Information of children under 16 to third parties for valuable consideration or for cross-context behavioral advertising. If you are under 16, please do not use or provide any Personal Information on the Site. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. CHOICES CONCERNING COOKIES AND OTHER TRACKING TECHNOLOGIES

We automatically collect certain types of usage and device information when you visit our Site, read our emails, or otherwise engage with us, including our advertisements.  This information is typically collected through the use of cookies, web beacons or pixels and similar tracking technologies (collectively, “cookies”). YOUR PRIVACY RIGHTS AND CHOICES

This section provides additional disclosures for residents of U.S. states with data protection laws that apply to Pharmavite. The following describes those rights and explains how to exercise those rights.

RIGHT TO KNOW

You have the right to confirm whether we are processing your Personal Information and request that we disclose certain information to you about our collection and use of your Personal Information.  The information you have the right to request is:

  • The categories of Personal Information we have collected about you.
  • The categories of sources of the Personal Information we have collected about you.
  • Our business purposes for collecting, selling, or sharing the Personal Information.
  • Our business purposes for disclosing the Personal Information, as well as the categories of third parties to whom we have disclosed the information.

Please note that you can only make a verifiable request for access twice within a 12-month period.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. RIGHT TO DATA PORTABILITY

You have the right to request the specific pieces of Personal Information we have collected about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the Personal Information to another data controller.

RIGHT TO CORRECT

You have the right to request that we correct any inaccurate Personal Information we maintain about you. You can also change any of your Personal Information in your account by editing your profile within your account or by contacting us here.

RIGHT TO DELETE

You have the right to request that we delete any of your Personal Information that we collected from or about you, depending on your state of residence and subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers, contractors, and third parties to delete, as applicable and where required by applicable law) your Personal Information from our records, unless an exception applies.

Examples of circumstances in which we may deny a deletion request may include, depending on applicable law, contexts where retaining the Personal Information is necessary for us to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Help to ensure the security and integrity of our Site.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on the consumer’s relationship with us.
  • Comply with a legal obligation.

EXERCISING YOUR RIGHT TO KNOW, RIGHT TO CORRECTION, RIGHT TO DELETION, OR RIGHT TO DATA PORTABILITY

To exercise your right to know, right to correction, right to deletion, or right to data portability as described above, please submit a verifiable consumer request to us by completing our Webform or calling us toll-free at 1-800-276-2878. Only you, or you authorized agent, may make a verifiable consumer request related to your Personal Information.

To submit a request to know, correct, delete, or data portability, we require that you explain your relationship with us, specify your request type, and provide your name, and email address.  You also have the option to provide us with additional request details. We use this information to identify responsive records and to assist in verifying your identity. To verify your identity, we use a service provider who may ask additional questions to verify your identity, including your home address, country, your date of birth, the last four digits of your social security number, and other questions such as physical addresses or locations that you have been associated with.  Your request should include sufficient detail that allows us to properly understand, evaluate, and respond to it. Please note that we may require additional information from you to verify your identity and process your request.

If you choose to use an authorized agent to submit a request on your behalf, you must provide the agent written permission to do so and we may require the agent to provide proof that you gave the agent written permission to submit the request, in addition to the steps we would take if we processed your request directly. We may also ask you to verify your identity directly with us or to directly confirm with us that you provided the agent with permission to submit the request. If we are unable to verify your identity and/or the agent’s authority to submit the request, we may deny the request.

We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request and to fulfill that request.

RIGHT TO APPEAL

In certain circumstances, we may decline a request to exercise the rights described above. If your request is denied, we will provide an explanation for the denial and instructions on how you may appeal a denied request. You may appeal a denied request by contacting us at dsar-appeal@pharmavite.com.

RIGHT TO OPT-OUT OF SALES AND SHARING; RIGHT TO LIMIT

You have the right to direct us to not sell your Personal Information or to share your Personal Information for cross-context behavioral advertising (the “right to opt-out”). As indicated above, we do not sell or share the Personal Information of consumers we actually know are less than 16 years of age. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us via the methods listed below.

We generally only use and disclose Sensitive Personal information for the purposes listed in the California Consumer Privacy Act (“CCPA”) regulations, which include performance of goods and services reasonably expected by consumers who request them, prevention of security incidents and illegal actions (including fraud), protection of physical safety of individuals, short-term, transient use, including non-personalized advertising, performance of services on behalf of our business, verification and maintenance of the quality and safety of our products and services, and collection and processing of Sensitive Personal Information where such collection and processing is not for the purpose of inferring characteristics about a consumer.  However, as the definition of consumer health data may be broadly construed under certain state laws specific to consumer health data privacy (see Consumer Health Data Privacy Policy), we may use and disclose consumer health data as defined under such laws for the purposes listed in the “Purposes for Collection” section, above. To the extent such information may also be considered Sensitive Personal Information, you have the right to request that we limit our use and disclosure of Sensitive Personal Information we collect about you to the purposes listed in the CCPA regulations.  To exercise your right to limit to the extent applicable, you (or your authorized representative) may submit a request to us via the methods listed below.

RIGHT TO OPT OUT OF PROFILING

You have the right to opt out of use of your Personal Information for profiling in furtherance of a decision that produces a legal or similarly significant effect about you. However, please note that we do not process Personal Information for profiling in furtherance of decisions that have legal or similarly significant effects, such as decisions about access to housing, loans, healthcare services, employment opportunities, or access to basic necessities, such as food and water.

RIGHT TO NON-DISCRIMINATION

We will not discriminate against you for exercising any of your rights as set forth in this Privacy Policy. Unless permitted by the law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the law that can result in different prices, rates, or quality levels. Any legally permitted financial incentive we offer will reasonably relate to your Personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

CHANGES TO OUR PRIVACY POLICY

We reserve the right to amend this Privacy Policy at our discretion and at any time. This Privacy Policy will be reviewed at least once every 12 months and will reflect the date it was last updated.

LINKS TO THIRD-PARTY WEBSITES; SOCIAL MEDIA SITES

We may link to third-party websites and services that we do not operate and are outside of our control. We are not responsible for the security or privacy of any information collected by other websites or other services. Please exercise caution and review the privacy statements applicable to the third-party websites and services you use.

We may offer social sharing features or other integrated tools, which let you share actions you take with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the third party that provides the social sharing feature. If you visit this Site from outside the United States, please note that the United States has data protection laws that may not be consistent with those of other countries and that information collected about you in connection with your visit to this Site will be processed in accordance with United States law.
